Privacy policy

This privacy policy (hereinafter the “Privacy Policy”) describe the types of personal data that Fundación Alimentaris Argentina (hereinafter, “Alimentaris” or “us”) collects through the website http://alimentaris.org/  (hereinafter, the “Website”), as well as how we use your data, with whom we share the data, and the rights and options we made available to you in relation to the processing of your personal data. We also describe the measures implemented in order to protect the security of the personal data collected and the way in which users can contact us to obtain information on our privacy practices.

The data controller for the processing of the personal data is the Fundación Alimentaris Argentina, domiciliated in Franklin D. Roosevelt 2157, Office N° 302, City of Buenos Aires.

You grant your express, informed, voluntary and unequivocal consent to the inclusion of all personal data that you provide to us through the Website (including your own personal data and/or, where appropriate, those of minors, institutions and/or any other third party that you represent or over which you are authorized to share their personal data with Alimentaris) in databases owned by and under the responsibility of Alimentaris, as well as the processing of such personal data by automated and non-automated means for the purposes described in the following sections of this document and subject to the terms and conditions set forth herein.

1. COLLECTED DATA

Through the Website we collect certain information, including personal data, which may be from your own, the person you represent as a parent or guardian, the institution or any other third party you represent. Personal data is information that can directly or indirectly identify you or the person you represent. For Alimentaris, your privacy and the security of your information and that of the person you represent are very important. Therefore, we will only ask you for the information strictly necessary for you or your representative to use the services offered by Alimentaris. To this end, Alimentaris may request and process personal data, including but not limited to name, surname, telephone, e-mail, Uniform Bank Account Number, among others.

We collect such information when you or your representative choose to actively participate on the Website, and we also collect personal information about you when you provide us with direct information through the “Contact Us” section of the Website or when you donate to Alimentaris.

In addition to the information you provide directly to us, we also collect and/or process personal information about you through automated means, such as cookies, web beacons and similar technologies.

2. PROCESSING OF PERSONAL DATA

The data we collect may be used for the following purposes: 

  • to send you informative communications about activities and news;
  • to respond your queries, comments, complaints and suggestions and to provide you with support;
  • to create profiles in order to provide you with a better service;
  • to operate, evaluate and improve our Website and its services;
  • to comply with and enforce applicable legal requirements, contractual obligations, and our policies; and
  • for advertising and marketing.

In addition to the personal data you provide, we may collect personal data from third parties when you provide it to us or when they choose to interact with the Website through your person. In this regard, you warrant Alimentaris that you have a sufficient legal basis to transfer such personal data to Alimentaris.

In the event of using the information you provide in a manner other than as described above, we will inform you specifically at the time of collection.

Through the Website, we may also use third-party analytics services. The web analytics service providers that administer such services use technologies such as cookies, web server logs and web beacons to help us analyze how users use the Website. The information collected by these means (including IP address) may be disclosed to the providers of such analytics services, as well as other third parties who will make use of the information collected to, among other purposes, evaluate the use of the Website.

3. INFORMATION WE SHARE

Personal data that we collect through the Website may be disclosed to third parties only as described in this Privacy Policy. We may disclose such personal data to service providers who perform services on our behalf in accordance with our instructions and for the purposes detailed in this Privacy Policy, including, but not limited to, payment processors and cloud storage service providers. We do not authorize such service providers to share or disclose the personal data you provide except for those uses that are strictly necessary for the provision of the services on our behalf, or to comply with legal obligations.

Alimentaris understands the importance of maintaining the confidentiality of all personal data that may be collected. Therefore, in order to ensure such confidentiality, we undertake to enter into confidentiality agreements with each of the parties that process personal data.

In addition, we may disclose the personal data collected (i) if we are required to do so by law or legal proceeding, (ii) to law enforcement or other public officials upon lawful request, (iii) when we believe that such disclosure is necessary to prevent physical damages or financial loss to Alimentaris or third parties, or (iv) in connection with an investigation of fraudulent or unlawful activities or alleged fraudulent or unlawful activities. Also, you consent to the transfer of the personal data collected to a new foundation or entity, in the event that we merge or incorporate with another foundation and/or entity.

4. DATA TRANSFERS

The data collected may be assigned or transferred to third parties for the purposes established in this document. These transfers will be made to the extent necessary to maintain or fulfill the relationship between Alimentaris and you. 

Personal information collected through the Website may be transferred for the purposes described above to various third parties identified in this Privacy Policy, including our service providers. Such third parties may be located in countries or jurisdictions that may not have the same data protection regulations as those existing in Argentina and, consequently, have less protection, circumstance that you understand and consent to.

5. SECURITY OF PERSONAL DATA

The data collected will be kept strictly confidential and reserved. Alimentaris will only use such data to the extent that your relationship with us is in force and its use was strictly necessary for the fulfillment of Alimentaris’ obligations. Alimentaris complies with all personal data protection regulations and, in particular, with the Personal Data Protection Law No. 25,326 and its complementary regulations such as, for example, Regulation No. 47/2018 (hereinafter, the “Personal Data Protection Regulations”). To ensure the security of the personal data you provide to Alimentaris, the same criteria and the same degree of diligence will be applied as we use to safeguard our own information.

In particular, we implement administrative, technical, organizational, logical and physical security measures designed to protect the personal data you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Thus, to prevent unauthorized access, maintain data accuracy and ensure the correct use of the personal information you provide to us, Alimentaris has put in place certain physical, electronic, administrative and procedural safeguards and security procedures to safeguard and secure the personal data we collect online. We safeguard your personal information in accordance with established security standards and procedures and continually evaluate new technologies to protect that information. Alimentaris guarantees that our internal database processes comply with the legal security and confidentiality obligations imposed by the Personal Data Protection Regulations.

However, you acknowledge that the existing technical means that provide security are not unbreakable, and that even when all reasonable security precautions are taken, it is possible to suffer manipulation, destruction and/or loss of information. Finally, if you believe that your interaction with us is no longer secure (for example, if you believe that the security of an account you have with us has been compromised), please notify us immediately of the problem by emailing us at administración.ar@alimentaris.org.

6. USER´S RIGHTS AND OPTIONS

Alimentaris presumes the accuracy of all information provided by you. Consequently, Alimentaris does not verify, nor does it assume any obligation to verify, the accuracy, validity, sufficiency, legality and authenticity of the information you provide. You assume the responsibility to keep such information up to date at all times.

You or your representative, where applicable, may access, modify, delete and update the personal data provided at any time, by contacting us as set forth in the following sections. Likewise, you may request, at any time, the removal or blocking of your name from the databases for advertising purposes.

You may access the information you have provided to Alimentaris free of charge, at intervals of no less than six months, unless you can demonstrate a legitimate interest to that effect, in accordance with the provisions of the Personal Data Protection Regulations.

If the information provided is incorrect, you wish to update and/or delete it, we will correct, update and/or delete that information at your request free of charge. To exercise your rights of access, rectification, updating or deletion, as provided for in the Personal Data Protection Regulations, you should send an e-mail to: administración.ar@alimentaris.org indicating which right you wish to exercise and enclosing a digitalized copy of your national identity document.

The information provided by you will be stored while the relationship with Alimentaris is in force and for an additional period of up to 2 years after the personal data has been provided or your relationship with Alimentaris has ended, whichever occurs last, for the purposes of resolving any possible disputes, detecting and resolving incidents and for the period necessary to provide you with the services described in this document or for other legitimate purposes for which Alimentaris must retain your personal data.

The Agency for Access to Public Information, the supervisory body of Law No. 25,326, is responsible for handling complaints and claims filed in relation to non-compliance with the rules on protection of personal data.

7. MINORS

Our services are only available to those persons who have legal capacity to contract. Therefore, unless they do so through their parents or legal guardians and with their consent, those who do not comply with this condition should refrain from providing their personal data to be included in our databases and / or from using our services.

8. LINKS TO OTHER WEBSITES

The Website may contain links to other websites for your convenience and information. Those websites may be operated by companies that are not affiliated with us. Usually, linked websites have their own privacy policies or notices, which you should read if you visit them. We are not responsible for the content of websites other than ours, nor are we responsible for the use of such websites or the privacy practices of such websites.

9. UPDATES TO THIS PRIVACY POLICY

Alimentaris reserves the right to make changes or updates to this Privacy Policy at any time without prior notice, to reflect changes in our personal data practices, as required by applicable law, and in particular the Personal Data Protection Regulations, or to reflect changes in its own policies. In the case of material changes, we will notify you by posting a notice on the Website or by e-mail, indicating at the bottom of the Privacy Policy the date on which it was last updated. Any changes to this Privacy Policy will be effective upon posting on the Website. Your interaction with us after the introduction of these modifications will mean that you accept such modifications. Otherwise, you must tell us that you disagree, and we will proceed to remove you or anyone you represent.

11. APPLICABLE LAW

This Privacy Policy is governed by the laws of the Republic of Argentina. In the event of any dispute between you and Alimentaris, the parties agree to submit to the jurisdiction of the National Commercial Courts located in the City of Buenos Aires, expressly waiving any other jurisdiction and/or venue.
